KVKK Disclosure Notice

This disclosure notice has been prepared to inform you about the processing of your personal data by Winance Teknoloji Anonim Şirketi ("WinanceAI" or the "Company"), acting as data controller, pursuant to Turkish Law No. 6698 on the Protection of Personal Data ("KVKK"). It supplements our Privacy Policy and applies in addition to it for data subjects in Türkiye.

2. Personal Data Processed

• Contact data: the email address you submit through the early access (waitlist) form; and your name, email address and message content if you contact us by email.
• Transaction security data: IP address, date and time stamps and browser information that may be recorded in server logs in order to operate the website securely.

3. Purposes of Processing

• Creating and managing your early access list registration;
• Contacting you about the launch and the early access process;
• Responding to your requests and questions;
• Ensuring the security of the website;
• Fulfilling our legal obligations.

4. Legal Grounds for Processing

Your personal data is processed on the basis of your explicit consent under Article 5/1 of the KVKK (early access list registration and commercial electronic messages), our legitimate interests under Article 5/2(f) of the KVKK (website security and responding to your requests), and the fulfilment of legal obligations under Article 5/2(ç) of the KVKK.

5. Transfer of Personal Data

The email address you submit through the early access form is processed on the servers of our form infrastructure provider, Formspree, Inc. (USA). Accordingly, your data is transferred abroad on the basis of your explicit consent pursuant to Article 9 of the KVKK. Your data may also be shared with our hosting and infrastructure providers to the extent necessary to deliver the service. Beyond this, your personal data is not sold, rented or transferred to third parties for marketing purposes.

6. Method of Collection

Your personal data is collected electronically, through automated or partially automated means, via the forms on our website and by email.

7. Retention Period

Your personal data is retained for as long as required by the purposes of processing and, in any case, within the maximum periods prescribed by applicable legislation. When you request removal from the early access list, your email address is deleted within a reasonable period.

8. Your Rights Under Article 11 of the KVKK

• To learn whether your personal data is being processed;
• To request information if your personal data has been processed;
• To learn the purpose of processing and whether the data is used in accordance with that purpose;
• To know the third parties in Türkiye or abroad to whom your data is transferred;
• To request correction if your data is incomplete or inaccurate;
• To request erasure or destruction of your data within the framework of Article 7;
• To request that correction, erasure and destruction operations be notified to third parties to whom the data was transferred;
• To object to an adverse outcome arising from the analysis of your data exclusively by automated systems;
• To claim compensation if you suffer damage due to unlawful processing of your personal data.

9. How to Submit a Request

You may submit requests regarding your rights by email to info@winance.ai, or in writing to our postal address above, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller. Your applications are concluded free of charge within a maximum of 30 (thirty) days, depending on the nature of the request.
